Legal Requirements


Couples Living in Australia

You will need to complete a Notice of Intended Marriage form which must be signed by both parties and witnessed by the Civil Celebrant. This form is required to be lodged no later than one month and one day prior to the proposed marriage. The Notice of Intended Marriage is valid for up to 18 months.

You will each need to provide a Birth Certificate (if born overseas, a current Passport or Citizenship Certificate can be used), and a Divorce Decree Absolute if previously married, or a Death Certificate if your previous spouse is now deceased.


Interstate Couples (outside of NSW)

If living interstate, I will post your Notice of Intended Marriage to you. Your legal requirements as above remain the same, although your Notice of Intended Marriage must also be signed and witnessed by a Justice of the Peace (JP). Institutions such as banks, legal firms, and real estates usually have a JP on site who can do this for you. Simply take your unsigned Notice of Intended Marriage and other document/s mentioned above with you on the day. The JP will then ask you to sign in front of him/her and will then also sign as a witness.

You may then post your documents to me for lodgement. Soon as the original Notice of Intended Marriage (NOIM) form is received, the 30 days notification period begins.

30 days after notification of marriage, ceremony may be scheduled.

Your Notice of Intended Marriage is valid for up to 18 months.


Overseas Couples wishing to marry in Australia

The process and your requirements are the same as above, with your documents to be sighted and signed by a Justice of the Peace (JP). You may contact the nearest Australian Consulate for help with finding a JP closest to you.

Couples with one partner in Australia and one overseas will also require a letter from the Department of Immigration to support your fiance’s application to marry. I can assist you with this process.

You may then post your documents to me for lodgement. Soon as the original Notice of Intended Marriage (NOIM) form is received, the 30 days notification period begins.

30 days after notification of marriage, ceremony may be scheduled.

Your Notice of Intended Marriage is valid for up to 18 months.
